GENERAL DISCIPLINARY POLICY

General Misconduct for Brothers:

I. All brothers have the responsibility of intervening in instances of general misconduct.

II. If a brother witnesses or is made aware of any instance of general misconduct regarding brothers or guests, he shall inform the President and Executive Slate Officers (VP Alumni, VP Rush, Treasurer, and Risk Manager/FCS Compliance Officer) in order to appropriately respond.

III. Any brother whose conduct threatens the safety of any guest or brother at an event, public or private, shall be removed from the event and not allowed to return for its entirety. Subsequent disciplinary measures are outlined below:

a. Said brother shall not be permitted to attend further public events until they attend a mandatory disciplinary meeting with the Executive Slate.

b. At the discretion of the brotherhood, a brother found in violation of general disciplinary policy may be immediately suspended and deemed an inactive member for the remainder of the quarter.

c. At the discretion of the brotherhood, a brother found in violation of general disciplinary policy may be de-affiliated with a majority vote. 


General Misconduct for Guests:

I. At all public events guests are expected to conduct themselves in a way that fosters a safe environment for all. 

II. Any guest whose conduct threatens the safety of any other guest or brother shall be immediately 

asked to leave. It is the responsibility of all brothers to facilitate said guest’s departure in such a circumstance. 

a. If said guest declines to leave, they will be removed from the property.

III. The brotherhood holds the right to ban any individual at any time for an indefinite duration with a two-thirds majority vote. The same rules apply to reinstate a banned individual, except in the case that their misconduct was of a violent or sexual nature that can be confirmed by a police or University investigation or by a brother’s firsthand testimony. In such a case, no majority vote can suffice to reinstate the individual.


SEXUAL MISCONDUCT POLICY

Sexual violence refers to any sexual behavior, whether physical, verbal, or digital that occurs without consent of a party or parties involved. Sexual misconduct can also be used as an umbrella term per University policy referring to sexual assault (a criminal act that the U.S. Department of Education defines as a form of sexual harassment), sexual abuse, sexual harassment, stalking, dating violence, and domestic violence. Other acts that may be considered forms of sexual harassment and violence depending on the specific circumstances of the behavior include sexual advances, requests for sexual favors, or sexually-directed remarks or behavior. Such behavior constitutes sexual harassment when such conduct directed against an individual persists despite its rejection, or such conduct interferes in an injurious way with an individual’s academic, professional, or emotional life. 

To prevent and respond to sexual violence, brothers will adhere to the following policies:

I. Any brother formally accused of sexual misconduct shall immediately be suspended from the chapter and deemed an inactive member pending investigation by relevant authorities.

a. Suspended brothers may not attend any events on the premises.

b. If an investigation is not pending, or if the survivor does not wish to continue in the investigation, the brotherhood retains the power to de-affiliate the individual on a discretionary basis by vote of the undergraduate brothers.

II. If found guilty of sexual misconduct, the individual shall be immediately de-affiliated from the Chicago Chapter of the Alpha Delta Phi. Furthermore, the individual shall be banned from the property and all future Alpha Delta Phi events.

a. If relevant authorities decline to prosecute an accused individual, his reinstatement may be considered at the discretion of the brotherhood.

b. If relevant authorities find the accused individual not guilty of sexual assault, his reinstatement may be considered at the discretion of the brotherhood.

 

III. Any brother who witnesses an act of sexual misconduct or violence by another brother is obligated to bring this information forward to a member of the Executive Slate. If a perpetrator is found guilty and a brother is found to have willfully concealed such an act, the chapter will immediately suspend him, and there will be a discussion held to evaluate dismissal at the next chapter meeting.


IV. The Chicago Chapter of Alpha Delta Phi shall maintain a record of all allegations of sexual misconduct that are reported to the brotherhood.

  1. In the event that a brother is contacted regarding a case of sexual harassment or sexual assault, the brother (henceforth referred to as brother contact) should comfirm with the source the extent to which information should be shared among the brotherhood.

    1. If the source confirms their desire for information to be shared, the brother contact shall detail the incident at chapter meeting. 

  2. The brother contact that presents the case should make every attempt to respect the privacy of the source. 

    1. Unless explicitly permitted by the source, the brother contact should withhold identifying information about the incident and the source.

    2. If the source has requested to remain anonymous, the brother contact should respect said request unless extenuating circumstances require the disclosure of identity (possibly including but not limited to: safety of brothers, direct involvement of brothers, or issues of liability).

  3. All information added to the Alpha Delta Phi ban list shall be considered internal, and cannot be shared outside the Chicago chapter unless decided by a majority vote of the undergraduate brothers.

    1. An exception to the above rule may be made in the interest of an individual’s safety or potential liability. If any brother member deems it necessary to inform an individual outside of the chapter of minimum information regarding an allegation, they may do so at their discretion. In such cases, the brother member will make every attempt to withhold the name of the source, and will first inform either the President or Risk/FCS Compliance Officer(s) of their intent to share the information.

      1. In the spirit of Article IX of the Covenant of The Alpha Delta Phi, brother members should be conscientious and deliberate when choosing to share information outside the chapter. Any concerns or hesitation regarding requests for information should be made clear to the President or Risk/FCS Compliance Officer(s). 

    2. The ban list may be used to cross-reference names presented by external organizations. Decisions to share individual names and information from the ban list may be made at the discretion of the executive board and Risk/FCS Compliance Officers.



SEXUAL MISCONDUCT EDUCATION POLICY

I. All pledges shall attend a mandatory sexual violence prevention workshop prior to initiation. 

a. Failure to attend shall result in immediate dismissal from the pledging process.

II. All active brothers shall attend a mandatory sexual violence prevention workshop at least once per year. 

a. Failure to attend shall result in immediate suspension and inactive status until the brother attends a workshop and is reinstated at the discretion of the brotherhood.


EVENT MANAGEMENT POLICY

We have the duty of maintaining the safety and wellbeing of all guests at Alpha Delta Phi. To fulfill this duty, brothers will adhere to the following policies:

I. At least one member of the Executive Slate (President, VP Alumni, VP Rush, Treasurer, and Risk Manager/FCS Compliance Officer) shall be accessible at all public events.

a. The contact information of the executive slate will be made public prior to the event. This shall be posted on any social media promotion pages.

II. Brothers stationed at the entrance shall request all guests present their UCID prior to entry.

a. If a non-student requests entry, brothers stationed at the entrance have the power to allow or deny entry at their discretion.

III. In addition, there shall be printed copies of the Social Conduct Policy at the Chapter House at the front door, basement bathrooms, near the main room stairs, and in the basement.

IV. Water will be readily available from a labeled, sealed container or openly visible faucet, or upon request at every public event.

To prevent and respond to any potential safety issue at a public event, brothers will adhere to the following policy:

  • Any brother who fails to maintain sobriety during a safety monitor shift shall immediately be suspended from the chapter and deemed an inactive member for ten weeks.
